A new insurance industry report highlights the growing security and safety risks the shipping industry faces – from cyber attacks to piracy and super storms – and warns that shippers should be better prepared to handle these exposures. This report comes on the heels that 2015 was the safest year for the maritime industry in 10 years. Cyber Threats As ship owners and ports undertake the digitalization of their operations for greater efficiencies and growth, the risk of cyber threats is on the rise. Computerized systems are used for everything from navigation to container inspections, tracking and managing transit, and handling and release of cargo as well as terminal operations. While these smart ships and ports garner many benefits, they also open up the maritime industry to cyber attacks. Moreover, because global maritime logistics is highly integrated, it’s possible for a company in the supply chain to become a victim without having been the target. In fact, concern over cyber security in the shipping industry is a top-of-mind issue on the agenda of the International Maritime Organization’s (IMO) Facilitation and Maritime Safety Committees. According to the IMO, both committees are working collaboratively in the development of voluntary guidelines on adequate anti-cyber security practices, which may be used to protect and enhance the resilience of automated systems supporting the operations of ports, vessels, marine facilities and other elements of the maritime transportation system. Indeed, the 96th session of the IMO’s Maritime Safety Committee taking place in London next month will be reviewing cyber security proposals that were presented last year. Meanwhile, in January a group of international shipping organizations, which included Cruise Lines International Association, Intercargo, Intertanko and the International Chamber of Shipping, released guidelines to help shipping companies prevent cyber attacks. The group’s guidelines to lower cyber security risks include: how to raise awareness of safety and commercial risks to shipping if no guidelines are in place; how to protect IT infrastructure and connected equipment; how to make sure users have appropriate access to information; and how to protect data flowing between the ship and shore-side offices. Piracy Piracy also remains an issue for the maritime industry with attempted pirate attacks on ships having moved from Somalia as a primary focus to Southeast Asia. According to the Singapore-based Regional Cooperation Agreement on Combating Piracy and Armed Robbery against Ships in Asia (ReCAAP), 183 actual or attempted attacks took place in Southeast Asian waters during 2014. This figure represents a marked increase from 150 in 2013 and 133 in 2012, and is the highest since 2006. The latest figures released by the International Maritime Bureau’s (IMB) Piracy Reporting Center corroborate ReCAAP’s findings and show a similar increase in attacks in 2013 and 2014. Since a total of 245 attacks took place worldwide in 2014, Asia now accounts for up to 75% of all piracy and armed robbery (PAR) incidents in the world, up from 60% in 2013. Additionally, concerns have been raised over the fact that pirates are beginning to identify vulnerabilities in cyber defenses. Extreme Weather Conditions In the last year, three of the five largest vessels lost were due to bad weather. Exceptional weather events are becoming more commonplace, bringing additional risks and disruption to supply chains. The most recent loss was the El Faro, which sunk as it approached the Bahamas en-route from Florida to San Juan, Puerto Rico during Hurricane Joaquin, and killed 33 crew members. Additionally, it is expected that more aggressive marketing by these companies which mainly use domestic ports will help to partially prevent an outflow of transshipment cargo.

Only one carrier alliance has ever failed to get these approvals, and that was when China’s Ministry of Commerce halted the P3 Network back in 2014. With its own China COSCO Shipping Corporation in the OCEAN Alliance, it’s very unlikely China will say no to the alliance moving forward. By the end of next year, all of ocean shipping should be run by three major alliances: 2M, OCEAN alliance, and THE Alliance or THE Alliance—I’m not sure how I’m supposed to say that one, but it doesn’t really matter because that alliance was supposed to include Hanjin Shipping, and, well, yeah. They’ll have to rethink things. Which hopefully includes a new name. Speaking of Hanjin Shipping, the bankrupt carrier is looking closer and closer to complete liquidation as the announcement was made it is closing its European operations. This is on top of news of Hanjin working on selling it stake in Total Terminals International (TTI) at the Port of Long Beach, putting its Asia to U.S. assets up for sale, along with trying to sell the ships it owns. Beginning July 1, 2016, the International Maritime Organization (IMO) approved amendments to The International Convention for the Safety of Life at Sea Convention (SOLAS), requiring that shippers verify gross container weight prior to shipping. The requirement will become not just international law under the IMO but also national law within the 170 countries and three associate members that are signatories to the IMO. After July 1, 2016, it would be a violation of SOLAS to load a packed container onto a vessel if the vessel operator and marine terminal operator do not have the verified gross mass (VGM). According to the Journal of Commerce (JOC), “early analysis suggests the ocean carrier and the marine terminal will be strict in not accepting containers lacking an accompanying VGM since under the SOLAS rule they can be held responsible for loading a container for which a VGM hasn’t been provided.” Shippers, freight forwarders, vessel operators, and terminal operators will all need to establish policies and procedures to ensure the implementation of this regulatory change. Following is some basics of the new requirement: - To meet the new container weight mandate, the cargo must either be weighed at the loading container at an approved weighing station; or all items in the container weighed and then included in the overall container’s weight calculation. - The shipper named on the ocean bill ultimately bears the responsibility for weight verification, and must communicate the verified weight in advance, to allow the ship’s master and the terminal representative to prepare the ship stowage plan accordingly. Note that the responsibility of the shipper doesn’t go away if a shipper uses a forwarder to pack and weigh a container, forward it to the port and even make the booking with the carrier. - The shipper weight verification to be compliant with the SOLAS requirement must be “signed”, which means a specific person representing the shipper is named and identified as having verified the accuracy of the weight calculation on behalf of the shipper. The signature may be an electronic signature or may be replaced by the name in capitals of the person authorized to sign it. The VGM and signature can be part of the shipping instructions communicated via electronic data interchange (EDI), or be contained within a separate communication including a hard copy document. - The container should not be loaded onto the vessel if the shipper did not provide the packed container’s verified weight prior to shipping, unless the master or the terminal can obtain the verified weight through other means. - Maritime authorities of individual nations will endorse the rule, with regulatory implementation varying depending on the country and region. According to the JOC, “enforcement will likely be carried out directly by the container lines and terminal operators, who are both required not to load a container without the certified VGM document accompanying it.
